Can I safely update from V 2.88c to latest v3 build? on a live enviroment? sorry if someone already ask this I cannot find.

yes it has being asked before.
you cannot upgrade from v2 to v3. i dont know the specifics. maybe because it has a different database structure
however you can still update to 2.99c
If we cannot upgrade from V2 to V3, is there at least a way to migrate data?
No migration tools. V3 was a complete re-write for SambaPOS
